1. What is GB/T 33251?
GB/T 33251-2016 is a recommended national standard of China, titled Intellectual Property Management Specification for Institutions of Higher Education. It was issued on December 13, 2016, and implemented on January 1, 2017. It is currently in effect, under the jurisdiction of the National Technical Committee on Knowledge Management Standardization, and drafted by the State Intellectual Property Office, the Ministry of Education, and other relevant authorities.
2. Core Positioning and Scope of Application
• Positioning: To provide a systematic framework for universities to establish, implement, and improve their intellectual property (IP) management systems, integrating IP into the entire process of scientific research, teaching, achievement transformation, and social services, and promoting both innovation and management with a focus on transformation.
• Scope: Applicable to all types of institutions of higher education; other educational organizations such as research institutes and vocational colleges may implement it by reference.
3. Core Control Elements
(1) Documentation and Organizational Management
• Establish an IP management document system and control processes.
• Clarify the responsibilities of the university president, set up an IP management committee, a full-time IP management office, and supporting service teams, and define the responsibilities of schools/departments and research teams. IP consultants may be appointed if necessary.
(2) Resource Support
• Ensure human, financial, infrastructure, and information resources to support the full lifecycle management of IP.
(3) IP Acquisition
• Standardize the generation and registration procedures for patents, trademarks, copyrights, trade secrets, and other types of IP arising from scientific research projects in natural sciences, humanities, and social sciences.
(4) IP Utilization
• Implement hierarchical management of research outputs, plan promotion, licensing, transfer, and equity investment, and other transformation paths to enhance the value of IP assets.
(5) IP Protection
• Establish mechanisms for infringement monitoring, early warning, and response, properly handle disputes, and safeguard the legitimate rights and interests of the university, faculty, and students.
(6) Review and Improvement
• Conduct internal audits, management reviews, and performance monitoring to continuously optimize the IP management system and achieve closed-loop improvement.
